Terms & Conditions

These Terms & Conditions govern access to and use of My Attendance (Mobile App, Admin Web, Super Admin Web). By using the platform, you agree to these terms.

1. Acceptance

By accessing or using My Attendance (Mobile App, Admin Web, Super Admin Web), you agree to these Terms & Conditions.

2. Services Provided

My Attendance provides an End-to-End Attendance Management System including:

Employee Mobile App
  • GPS-based Check-in / Check-out
  • Premises-based validation
  • Real-time accuracy Attendance
  • Break / Lunch punches
  • Work From Home attendance capture
  • Shift view (start/end/grace period)
  • Notifications
  • Holidays
  • Notices
  • Profile access
Admin Web Portal
  • Employee / Department / Designation masters
  • Holiday & Shift management
  • CSV bulk upload
  • Attendance & Overtime reports
  • Leave management
  • Premises configuration
  • Device binding
  • Employee documentation upload
Super Admin Portal
  • Company creation
  • Master setup (Country/State/City)
  • Logo management
  • Premises type creation

3. Employer Obligations

The Employer agrees to:

  • Obtain employee consent where required
  • Configure premises accurately
  • Ensure compliance with Indian labour laws
  • Maintain confidentiality of login credentials
  • Use system lawfully

4. User Responsibilities

Users shall not:

  • Falsify attendance using GPS manipulation
  • Attempt to bypass device binding
  • Attempt unauthorized access
  • Reverse engineer the system
Violation may result in suspension.

5. Device Binding

The platform may restrict login to designated devices. Circumvention is strictly prohibited.

6. Fees & Payment

Where applicable:

  • Services are subscription-based
  • Fees must be paid as per agreement
  • Non-payment may result in suspension
  • Fees are non-refundable unless contractually agreed

7. Intellectual Property

All software, source code, UI, architecture, trademarks, and branding remain the exclusive property of My Attendance. No rights are transferred except limited usage rights.

8. Accuracy of Reports

Attendance and overtime reports are system-generated based on configured rules and user inputs. We are not responsible for:

  • Incorrect configuration by employer
  • GPS inaccuracies due to device limitations
  • Incorrect employee data entered by HR

9. Limitation of Liability

To the maximum extent permitted under Indian law, My Attendance shall not be liable for:

  • Indirect or consequential damages
  • Employment disputes arising from attendance records
  • Business interruption
Total liability shall not exceed the subscription fees paid in the previous 12 months.

10. Confidentiality

Both parties agree to maintain confidentiality of proprietary and sensitive information.

11. Suspension & Termination

We may suspend or terminate access if:

  • Terms are violated
  • Fees are unpaid
  • Fraudulent or unlawful activity is detected

12. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Courts located in Pune, India shall have exclusive jurisdiction.

13. Amendments

We reserve the right to update these Terms. Continued use constitutes acceptance.
